

A Canadian judge who appeared never to have heard of civil disobedience not only condemned pro-life hero Mary Wagner as he sentenced her for entering a Toronto abortion facility — he condemned her God as well.
A pro-abortion spokesperson approved the judge’s words but the head of the Canadian Catholic Civil Rights League said they suggested an anti-religious bias and she was considering a complaint to the Judicial Council.
“You’re wrong, and your God’s wrong,” Justice S. Ford Clements told Mary Wagner, 38, as he sentenced her to 92 days in jail for her November intrusion into a Toronto abortion business.
His comment, first reported by LifeSiteNews, who had a reporter in the courtroom, was confirmed by Wagner's attorney.
In sentencing Wagner to 92 days, Clements ignored a joint recommendation from the Crown prosecutor and her own defense attorney that she be sentenced to the 88 days she had already served before trial.
The joint submission recommended three years probation as well, but the judge asked Wagner if she would promise to stay away from Ontario abortion facilities during the three years.
“I will not,” she declared.
Clements’ comments on God came in the middle of a tirade against Wagner for what he evidently viewed as her insensitivity to the feelings of women using the abortion facilities. “You don’t have the right to cause extra pain and grief in the way you do,” he told her. However, according to Wagner’s defense lawyer, Russell Browne, the Crown introduced no evidence from clients of the abortuary as to “pain and grief.”
Is Judge Biased?
Browne told the Register he would be looking closely at the transcript of the sentencing hearing for “an apprehension of bias” on the part of the judge, adding that he was planning to appeal both Wagner’s sentence and her conviction for “mischief to property.”
“It certainly caught me by surprise,” Browne said of the judge’s comments. And the judge, by asking Wagner about her intentions to re-offend, may have been “forcing her to testify” against herself, which is unlawful in Canada, as it is in American law.
Browne said he would appeal the sentence on the grounds that Wagner’s 88 days already served was in line with previous sentencing for second offences for abortuary occupations. Her intentions during probation should have been immaterial to what was, in Browne’s view, a technical matter.
Browne will appeal the conviction on the principle of Wagner’s constitutional right to free speech.
The judge, said Browne, apparently wanted to mix it up with Wagner over her comments about obeying a higher law than the law of Canada. “He did say, ‘If you don’t like the law, then go change it; don’t disobey it,” said Browne, so the judge didn’t need to launch an attack on his client’s faith.
Joseph Ben Ami of the Ottawa-based Canadian Centre for Policy Studies called Clements’ comments “profoundly absurd,” adding, “They call into question whether the judge is without bias. Even if I were an atheist, this, to me, is a stupid thing for a judge to say.”
Law to Protect People’s Feelings?
Ben Ami added that there is a tradition in Western culture for laws to be changed through civil disobedience. “It’s absolutely a good thing that there are people willing to go to jail to change the law. But here the judge seems to be saying the law is there to protect people’s feelings.”
The Canadian Civil Liberties Association declined to comment on Clements’ remarks. However, Mary Ellen Douglas of the Campaign Life Coalition of Canada termed Clements’ remarks “very biased and anti-Christian.” She also scoffed at testimony during the trial from the abortion facility’s owner to the effect that Wagner’s presence made her fearful. “Some of us pro-lifers might be scary, but not Mary. She is the gentlest of souls. They just can’t take anybody saying that abortion is killing a baby.”
While the coalition does not enter abortuaries or enter the so-called “bubble zones” courts have established around some facilities, said Douglas, it does not criticize Wagner or Linda Gibbons, Canada’s other pro-life prisoner, for doing so. “The distance we stay away does make it hard to reach the women. Linda and Mary take the route they do to take the message to the women,” she said.
However, Joyce Arthur, executive director of the Abortion Rights Coalition of Canada, told the Register, “Mary got what she deserves. What she doesn’t deserve is this reputation for being meek and mild. She’s actually quite aggressive. She goes right into clinics and even the ones who just stand there and do nothing are harmful because the anxiety, stress and fear it creates can increase the risk of medical complications, both physical and psychological. The clinic staff have to continually deal with this fallout.”
As for the judge’s comments, Arthur said she was glad to “hear someone tell it like it is.”
On the other hand, Joanne McGarry, executive director of the Canadian Catholic Civil Rights League, called the comments “very inappropriate. She added, “We are considering a complaint to the judicial council.”
Wagner, contacted through her lawyer, said she remained committed to her vocation of counseling women seeking abortion. To her mother, Jayne Wagner of Nanaimo, British Columbia, she said, “I am at peace, Mom.”

As people wake up to the horror we’re tolerating in abortion, finally reaching critical mass, the judiciary will no longer be able to dictate endorsement of abortion.

The theme of your commentary is clearly a rationalization(s) for the evil of killing an “unwanted” child. I agree with the notion that contraception and education MAY be of assistance (however, the research in this are does not bear out your contentions, due to the fact that sooner of later all contraceptives fail) but they will never replace a culture that condemns the sins of non-marital sex and actively enforces those values. No sane individual condones the killing of an abortionist, however your logic is flawed again. She ENTERED the clinic? I’m sorry, but that’s trespassing, I cannot agree with her action there. I don’t care how gentle she is, if she walked into my house without my invitation, she would be asked to leave and not re-enter unless I invited her.

Ignoring the woman in the process is what is inhumane, especially if she’s been raped. Not everyone is cut out for motherhood. Or they’re too young to be a mother, or they couldn’t afford to raise a child. Some people don’t want to put a burden on society by bringing yet another child into the world. I don’t see too many of the people who are protesting abortion going to the effort to adopt the unwanted children who end up having to live ‘in the system’ of foster care or children’s homes. How many of you have adopted a child? Be honest with yourself.
Whilst I don’t think abortions should be performed after 16 weeks, I do think it’s acceptable to permit them before this time; but a better solution is to educate children about procreation and ensure that if they are going to be sexually active, that everyone uses contraception, preferably condoms since they also protect against disease transmission. Anything else is unrealistic and short sighted.
The judge was abiding by Canada’s laws as they stand now, he can do nothing else. Was he a bit severe on Mary by adding a few days to her sentence? Maybe. But he did not break any laws. She did. If being harsh helps to avert the kind of situations seen in the USA where people feel so emboldened by the cause that they think it’s ok to shoot abortion clinic workers (in a totally illogical thought process that values a weeks old fetus over that of a viable and valuable medical practitioner) then so much the better.

The abortion does that. The GUILT from the abortion is responsible for this “extra pain and grief” - not Mary. The lack of Truth about abortion is what causes pain and grief because it’s too late once the act is done to reverse it and the fact that the likes of Planned Parenthood and other “women’s health providers” won’t speak frankly about it by hiding the other choices is really not giving girls a REAL choice. I cannot understand how a Judge can become so biased against someone who in there to counsel somebody over the truth in depriving a conceived child in the womb the right to live. Do we not see the many possible health and emotional hazards, let alone the spiritual well being, that one exposed to these practices may experience? I am so impressed by this young sister and how she stood up to an inferior being that sits in high places for a time. It is quite difficult to operate in the Freemason/Crown Templer controlled courts, and to stand up and say what is right in front of the moneychangers no doubt pleased our God and all of Heaven that were tuned in at the time. I don’t know if she had an attorney, but the best thing to do is never have one and appear in propia persona (proper person). They play games and an attorney gives them the opportunity to keep us a ward of the court. Under this United States Corporation there is much protection for those who simply “present themselves” rather than to be “re-presented.” We have protection under United States Code Title 42 subsection 1983 that protects us from what is called “color of law” which is not a law at all. Read about that and Title 28 subsection 241 and 242 which is RICO act. You can sue these men with no attorney, thus binding them. You can sue this judge by his name and not his title under Title 42 under the jurisdiction of thtle 28 and once the case is won, the case is ammended to be a Title 28 RICO and the FEMA camps they built for us will be used for them. US Code is valid in CANADA as CANADA is a subsidiary of US which is subsidiary of CROWN CORPORATION, based in a small area like Washington DC called CITY of LONDON, which is a city within greater London and not a part of it. There are a lot of people who respond in the name of “whomever”, without knowing or with litle regard for what “whomever” stood for, stands for, preached, or thought. Quite often, they are responding for themselves and hiding behind those they profess to stand for. Many of our political talkshow hosts profess violence and discrimination while hiding behind conservative political platitudes. This unfortunately has bred in our society a public who listens to popular opinion rather than investigating for themselves. The tragic result is that in spite of increased communication worldwide, there is less knowledge of the world on the part of the general public. Truth is substantiated over time, but untruths are untrue regardless of how much proliferation they enjoy, lest we forget that morality comes from God’s truth, not from man’s laws which can be flawed and partisan. Keep praying for true peace, which can only come through God. It does not require legislation and is lasting well beyond.

I met Mary Wagner and I truly am inspired by her efforts. She is an inspiration to Catholics worldwide and Canada is lucky to have her as an advocate, she is such a strong and courageous being and I pray that a law will be passed to protect the rights of the unborn. If killing a pregnant woman is considered double murder, then why isn’t aborting a fetus considered as such a grave injustice? Why do I fear that if that judge read “Inherit the Wind” he wouldn’t make the connection to himself, precisely because the judge in that was arguing from the opposite side of the religious spectrum?

I went to a planned parenthood clinic to pray outside with some other people for the first time in my life and just the thought of what was going there I felt scared and afraid of going closer to the clinic, I felt so sad and felt like crying that I could not even get out of the car, finally I got out and prayed and prayed together with the othe people that were with me. I feel that Miss Wagner is very brave and she deserves a medal for her courage! Jesus Christ have Mercy on us!
Even if pro-lifers’ presence causes the customers and staff of an abortion mill some additional anxiety, this is not an adequate justification to keep good souls like Mary from trying to save the LIFE of unborn children. I’m sure Rosa Parks made bus drivers and bigoted white passenger nervous, but she did the right thing. Well, here we are talking not just about equal treatment, but about the unjust taking of human life. The outreach should always be peaceful, but you can’t always make everyone feel good about themselves when human being’s lives are at stake—both the child, and the mothers, who will have deep wounds emotionally and sometimes even physically from the wretched experience of abortion.

While I disagree with people entering abortion clinics to make their statement about what is going on there, the employees and the clients using the facilities should be more than a little “uncomfortable” with what they are doing. Taking the life of an unborn child should be at least a “little” unsettling. When it isn’t, there inlies the problem. It’s the desensitization to it all that is the most troubling. In this misguided world, down is the new up and wrong is the new right. God help us!
We shut down Planned Parenthood in Prescott with 40 Days for Life. We just quietly sat outside the facility saying the rosary, day in and day out. I think it’s far more effective than the in-your-face tactics employed by Protestant groups. When you turn away from the Mother of God, you turn away from Her quiet strength.

Unfortunately, in Canada hate speech law applies to and and anything but Christians, especially Catholics. It is open season on the Christian faith and insults are rained down regularly, most especially on the Catholic Church without protests from the “rights” activists. I suppose that is a good sign according to the Gospel…if you follow Christ you will be vilified.
There are many judges acting against God will. Being a judge does not mean that you know everything. Chidren are often wiser than them. But it certainly shows that the devil exists.

I say: The only Christians I can think of that do this are Fred Phelps and his crew. In that circumstance, I think a good case can be made for a disturbing the peace charge which law enforcement seems to have lost the will to enforce these days. Even Our Lord used military metaphors, ministered and healed soldiers, and John the Baptist counseled soldiers on how to conduct themselves. As far as cutting social programs, there are no social programs that have Holy Writ on them. We are obligated to do works of mercy, we are not obligated to support any particular government entitlement program, many of which violate the principle of subsidarity. By running his mouth off IN COURT, he gave the defense grounds for appeal on a silver platter. They would be stupid not to pursue it.
The so called judge is uncivilized barbarian. He seems to have no knowledge about the existence of views, principles, faith other than his. All these are happening because the Catholics are sleeping with lack of faith in Jesus Christ. First the catholics of Canada have to be evangelized. The judge stated that abortion causes “pain and grief”. That will be a surprise to Planned Parenthood. At least we can thank the judge for making one truthful statement.

Sadly in Canada there are no abortion laws at all. Until the baby is completely separated from mother it may be killed. One brave Member of Parliament is trying to open a discussion as to when personhood begins. Please pray for his efforts and everyone in the Pro Life cause.

Some think that it’s alright to kill adults,too. If it’s what they believe, then they must be right. According to this judge, perhaps the murderers should be let out of jail, since murder is apparently merely a matter of opinion.

This Justice S. Ford Clements of Ontario Canada, needs to be prosecuted for accomplice to murder of the innocent.
