COMMENTARY: In a 6-3 decision, the justices lift a stay blocking enforcement of a state policy that allowed schools to facilitate a child’s gender transition without parental knowledge or consent.
Dec. 22, 2025, ruling struck down the secretive policies on First Amendment grounds and held that parents ‘have a right’ to the ‘gender information’ of their children, while teachers themselves also have the right to provide parents with that information. But a U.S. Court of Appeals for the 9th Circuit blocked that order Jan. 5.
The Lone Star State already ranks among 26 states with a Parents’ Bill of Rights enshrined in state law.
For Catholics, the tests raise deeper questions about parental rights and the relationship between the state and the family.
