COMMENTARY: The court will rule whether states have the authority to safeguard female athletes or whether such protections must be subject to individualized assessments and constitutional protections.
Idaho and West Virginia both have laws that ban transgender athletes from competing on sports teams at public schools and universities that do not correspond with their sex assigned at birth. There are 25 other states that have such laws.
The committee said it had updated its policies to ensure ‘fair and safe competition environments for women.’

The U.S. Department of Education’s Office for Civil Rights has found the California Department of Education and the state’s Interscholastic Federation to be in violation of Title IX for allowing male athletes who believe themselves to be females to compete in women’s sports.

In a statement released by the bishops’ conference, Bishop Robert Barron and Bishop David O’Connell called the Protection of Women and Girls in Sports Act ‘commonsense legislation that would ensure fairness for female athletes.’
The NCAA policy still allows biological men who identify as transgender to participate in women’s sports practices and receive benefits such as medical care during practice.
