COMMENTARY: In the 18 months since Roe v. Wade was overruled, supreme courts in Montana, North Dakota and South Carolina (at first) have overturned abortion bans in favor of women’s privacy and autonomy. Will the high courts in Arizona, New Mexico, Texas and Wyoming follow suit?
The Supreme Court will be reviewing a lower court’s August ruling that reimposed restrictions on the abortion drug mifepristone.
Given that chemical abortions now account for over half of all U.S. abortions, this ruling carries significant implications for the entire country, including states where abortion remains legally protected.
Four governors intend to have a surplus on hand.

Yesterday’s policy change comes after a December 2021 change that permanently lifted the requirement for patients to obtain mifepristone during in-person appointments with a physician.
Pro-life experts point out that these concerns also apply to mail-order and telehealth abortions, for which the FDA lifted its restrictions in December 2021.
