The case dates back to 2017, when the ACLU sued the administration on behalf of an unnamed 17 year-old immigrant who alleged that she had requested an abortion while in a federally-operated shelter in Texas but was not able to procure one because of federal policies.
The high court vacated an appellate court’s decision from October that permitted an undocumented minor to an obtain an abortion.
But the government says it has an interest in ‘not providing incentives for pregnant minors to illegally cross the border to obtain elective abortions.’
