COMMENTARY: In a 6-3 decision, the court held that Maine violated the Constitution by preventing families from using state aid to send children to schools that provide what it calls ‘sectarian’ instruction.
For years, legal experts have been discussing possible battles over access to federal benefits and accreditation of religious schools, based on their acceptance of ideas such as same-sex marriage and accommodation of persons identifying as LGBT.
On Monday, the governor said that “Private and parochial schools deserve the same opportunity and flexibility to make reopening decisions based on public health guidelines."
