The case of Colorado web designer Lorie Smith, as argued before the Supreme Court, is not about free exercise of religion but freedom of speech, and almost certainly it will be decided that way.
The court agreed Feb. 22 to consider ‘whether applying a public-accommodation law to compel an artist to speak or stay silent violates the Free Speech Clause of the First Amendment.’
The ads featured images of parents kissing a baby, a weeping mother, and a woman holding a pregnancy test, with the phrases “We love life,” “You are not alone,” and “I mourn my child.”
COMMENTARY: The unjust ruling by the 10th Circuit Court of Appeals cries out to the Supreme Court for its reversal.
