The justices denied review of a Fourth Circuit ruling siding with Grimm, who argued that school policies requiring transgender students to use the bathroom aligned with their biological sex violated Title IX protections against discrimination, but the rebuff did not address the case’s merits.
According to the Trump administration, the policy created too much confusion and the issue should be left up to the states.
At least four states have filed legislation to restrict use of public restrooms to biological sex.
The injunction block’s the Obama administration’s interpretation of Title IX, a federal law which bars discrimination on the basis of sex in schools that directly receive federal money.
